Health App Users Win $59,500,000 in Settlement Over Alleged Collection and Disclosure of Personal Data


Three companies have agreed to settle a class-action lawsuit brought over accusations that sensitive user data was shared with third-party companies without consent.

According to the newly updated settlement administrator portal, the menstrual and ovulation tracker app Flo Health is alleged to be subscriber Users’ menstrual and/or pregnancy data with third-party companies after integrating software development kits (SDKs) provided by Flurry, Meta, and Google.

The plaintiffs claim that this practice is against the law violates Flo Health’s privacy policy, which states that it will not “send any of your personal data to third parties…unless we ask for your explicit consent.”

Google agreed to pay $48 million, Flo $8 million, and Flurry $3.5 million, for a total of $59.5 million.

The settlement fund will be Distributed For users who submit a claim on a pro-rata basis after paying expenses, such as administrative costs, service awards, taxes, and litigation expenses. Eligible claimants are users whose data has allegedly been shared with third-party companies.

“Unless excluded, you are a member of the National Chapter if you used the Flo App in the United States between November 1, 2016, and February 28, 2019; and entered your menstrual and/or pregnancy information into the Flo App during that period.

Unless excluded, you are a member of the California Subclass if you used the Flo app in California between November 1, 2016 and February 28, 2019; You were living in California during that time; and entered menstrual and/or pregnancy information into the Flo app during that period.”

The three technology companies deny any and all allegations and say they agreed to the settlement “to remove the uncertainty, burden and expense and delay further protracted litigation.”

The final settlement approval hearing is scheduled for October 29.
