Costco has agreed to a $14 million class action settlement to resolve allegations that it sent promotional emails to consumers in Washington that contained false or misleading subject lines.
The settlement received preliminary approval on June 23, 2026.
The case Covers Washington residents who received commercial email from Costco, or someone acting on behalf of the retailer, between June 2, 2021, and July 7, 2026.
The lawsuit alleged that Costco violated the Commercial Email Act (CEMA) and the Washington Consumer Protection Act (CPA) by using deceptive subject lines to advertise limited-time promotions when the company knew it would extend those promotions beyond the specified time frame.
According to court documents, examples of emails Included Subject lines like “Today is the last day to access members-only savings” and “Hot buys only available for 5 days.”
Eligible class members who submit a valid claim may receive a cash payment from the Settlement Fund. The amount each person receives depends on the total number of approved claims and other factors. No proof is required to file a claim.
Claims can be submitted connected Or by sending the completed claim form to the adjuster.
The deadline to file a claim is August 24, 2026. Those who want to opt out or object to the settlement can do so by August 24.
The final approval hearing is scheduled for October 2, 2026.
Costco maintains that it complied with the law and does not admit any wrongdoing.
